‘Nevermind Baby’ Reinstates Nirvana Album Cover Lawsuit

“Nevermind Baby” Spencer Elden refiled his case against the Nirvana band members before the January 13 deadline.

Spencer Elden, the naked baby photographed on the cover of the Nirvana album Not serious, reinstated its lawsuit against the group after it was dismissed last week, alleging “child sexual abuse images”.

The amended lawsuit was filed Wednesday, meeting the deadline set by a California federal judge after the cases were dismissed on Jan. 4. Elden, now 30, has reinstated his charges against band members Dave Grohl, Chad Channing, Krist Novoselic and the late Kurt. Cobain, as well as numerous record labels and photographer Kurt Weddle.

“Spencer’s image constitutes child pornography and each of the Nirvana defendants deprived our client of his dignity and privacy,” his attorney said in a statement to USA Today. “This unprecedented album cover may be the first and only time a child’s frontal nudity has been used to sell a product.”

The best-selling album from iconic grunge band Nirvana, Not serious has sold over 30 million copies worldwide. Elden, the baby chasing the dollar, is depicted on each of them.

Elden’s attorneys say the group prioritized profit over safety, “[Nirvana] took advantage of the lascivious nature of his image to promote the Not serious Nirvana’s album, band and music, while earning, at minimum, tens of millions of dollars in total.

In their December 22 petition, Nirvana’s attorneys said that until recently Elden had been more than willing to join the cover – recreating the photo as an adult to celebrate Nirvana’s 15th and 25th anniversaries. album – laying the charge of “long-term damage”. unbelievable.
